This website is owned and operated by Permanent Cosmetics. All orders and purchases made through the facilities of this website shall be subject to these Online Shopping Terms and Conditions.
Permanent Cosmetics may correct errors or inaccuracies and change or update information on this website at any time without notice, including in respect of prices and availability of items. All prices listed on this website are in Australian dollars and all charges will be processed in Australian dollars.

All prices listed on this website are subject to confirmation. Permanent Cosmetics will notify you by email if the confirmed price of an item you have selected differs from the price listed on the website or on your purchase order.

Permanent Cosmetics reserves the right to limit the quantities of certain items which you, your family or any group can purchase. Permanent Cosmetics will use commercially reasonable efforts to deliver items as quickly as possible and within any time periods indicated; however, Permanent Cosmetics will not be responsible for any delays in delivery which are beyond its control. If goods are not available or there is a delay in delivery Permanent Cosmetics will notify its customers within 5 business days.

Goods will be shipped via courier. Once Payment has been received and processed, goods will be shipped, please allow 7-10 business days

Export Restrictions

Permanent Cosmetics will deliver to addresses within Australia only. Goods will not be shipped internationally.

Permanent Cosmetics is committed to complying with Australian Commonwealth legislation (http://www.privacy.gov.au/) governing privacy of personal information by businesses. Permanent Cosmetics is committed to the security of all information associated with our customers. We have security measures in place to attempt to protect against the loss, misuse and alteration of personal information under our control.

Any personal information you provide will only be used for the purpose for which you have provided it and will not be added to any third party mailing lists.

Security

Credit card payments are secured using 128-bit SSL encryption. This ensures all credit card details you send to us via the internet will be encrypted. If any other user intercepts the communication, they will only be able to view the encrypted form. This makes it impossible to be intercepted by an unauthorised party as long as your browser supports the use of encrypted data transmissions.

Fraud Prevention

In order to protect you and Permanent Cosmetics from fraudulent transactions, Permanent Cosmetics may provide your transaction-related information to a reputable third party organization to perform address verification. This address verification is intended to ensure that the “bill to” address that you provide matches your credit card address. Permanent Cosmetics also reserves the right, at its discretion, not to ship items ordered or purchased on this website to certain addresses.

Refunds

Defective items will be replaced. Permanent Cosmetics will not process Refunds for incorrect purchase or change of mind. All Refund requests need to be made in writing to orders@digitalpg.com.au within 7 days of purchase.

In the event that Permanent Cosmetics chooses not to ship an item, you will be notified by email and any amount charged to your credit card will be refunded.

Shipping Policy

• We only ship within Australia
• Delivery is via third party courier
• It is our company policy that we do not ship to Post Office box.
• All deliveries are sent with registered couriers and must be signed for at time of delivery. Under some special circumstances, courier deliveries may be replaced by Australia Post.
• Shipping address cannot be changed once order(s) has been shipped.
• As the registered couriers are third-party courier companies, we are unable to control their delivery time. The courier is also unable to ring you prior or during delivery.
• If the delivery is to your home address, it is best to ensure someone is home to receive the goods. If not, we recommend using an alternative, like your work address for delivery.
• If you are not home at the time of delivery additional delivery charges may apply.
• Order cannot be cancelled once order has been shipped.
• Shipping time may vary depending on your location, please allow 2 – 7 days for delivery.
• Shipping charges are determined by packing size, weight and delivery location.

Terms of Trade of Permanent Cosmetics

1.  DEFINITIONS:

1.1.  “Coupons” means any coupons or codes advertised by Permanent Cosmetics from time to time which can be redeemed for a percentage discount or special gift;
1.2.  “Goods” means the goods supplied by Permanent Cosmetics to you;
1.3.  “Permanent Cosmetics” means Permanent Cosmetics (ABN 34158561927);
1.4.  “Goods & Services”, means the products and services or either separately provided by Permanent Cosmetics at your request in respect of the goods and or services;
1.5.  “Terms” means these terms and conditions of trade;
1.6.  “You” means the person, firm, or corporation, jointly and severally if there is more than one, acquiring goods or services from Permanent Cosmetics.

2.  BASIS OF AGREEMENT AND ORDERING:

2.1.  These terms apply exclusively to every contract for the sale of goods or services entered into by Permanent Cosmetics and cannot be varied or supplanted by any other terms, including your terms and conditions of purchase (if any).
2.2.  Any quotation provided by Permanent Cosmetics to you concerning the proposed supply of goods or services is an invitation to treat only, and is subject to you entering into a contract with Permanent Cosmetics and accepting these terms.
2.3.  A contract is formed between Permanent Cosmetics and you when Permanent Cosmetics confirms by electronic means its acceptance of your order and receipt of your payment.
2.4.  Permanent Cosmetics in its absolute discretion may refuse to accept any order.
2.5.  An application by you to purchase products displayed on this website is subject to supply by littil’s contract manufacturers.

3.  PRICING AND PAYMENT:

3.1.  Prices displayed for the supply of goods or services include GST and any other taxes or duties imposed on or in relation to the goods or services. In addition payment of the price of the goods or services, you must pay any GST and any other taxes or duties incurred in relation to the goods or services.
3.2.  Where there is any change in the costs incurred by Permanent Cosmetics in relation to the goods or services, Permanent Cosmetics may vary its price for the goods or services to take account of such change, by notifying you.
3.3.  Payment for the goods or services must be made strictly by credit card through the site payment gateway or by arrangement for bulk orders by electronic funds transfer immediately upon confirmation of your order. Goods and services ordered will not be dispatched until full payment has been confirmed.
3.4.  Payment terms may be revoked or amended in Permanent Cosmetics’s sole discretion at any time immediately upon notice to you.
3.5.  Goods and services displayed on this website are subject to availability. If any goods and services ordered are not available, Permanent Cosmetics will inform you within 2 days. In the case of non-availability of goods or services:
3.5.1.  you may request the provision of substitute or similar goods or services; or
3.5.2.  cancel your order; and
3.6.  Permanent Cosmetics will make the appropriate adjustment to, or refund of, the purchase price.

4.  REDEMPTION OF COUPONS

4.1.  If and only when there is coupon campaign operation, coupons may only be redeemed at this Website, and are not redeemable for cash. You must enter the Coupon during the ordering process in order to redeem the percentage discount or free gift.
4.2.  Permanent Cosmetics reserves the right to vary or terminate the Coupon program at any time. Any special conditions from time to time relating to the redemption of the Coupons will be displayed on this Website.

5.  RISK AND INSURANCE:

5.1.  The risk in the goods and all insurance responsibility for theft, damage or otherwise in respect of the goods will pass to you immediately upon the goods being dispatched from the premises of Permanent Cosmetics or the relevant hosting warehouse as appropriate.
5.2.  You assume all risk and liability for loss, damage, or injury to persons or to your property or the property of third parties, arising out of the use or possession of any of the goods or services sold by Permanent Cosmetics.

6.  DELIVERY & FREIGHT:

6.1.  Permanent Cosmetics will, in its discretion, arrange for delivery of the goods or services to you at a nominated address within Australia.
6.2.  Permanent Cosmetics will designate the method of delivery of the goods or services. If you require a more costly method of delivery, you must reimburse Permanent Cosmetics for the extra cost involved.
6.3.  Unless expressly listed as “Freight Free”, you will be responsible for all costs associated with delivery, including postage or courier delivery, insurance and other charges arising from the point of dispatch of the goods to the point of delivery to the Australian address nominated by you.
6.4.  Any period or date for delivery of the goods or provision of the services stated by Permanent Cosmetics is intended as an estimate only and is not a contractual commitment. Permanent Cosmetics will use its reasonable endeavours to meet any estimated date for delivery of the goods or completion of the services, but will in no circumstances whatsoever, is liable for any loss or damage suffered by you or any third party for failure to meet any estimated date.
6.5.  A postage receipt completed by Permanent Cosmetics directing delivery to the address nominated by you will be proof of delivery of the goods and services.
6.6.  You may be required to provide photo identification and proof of payment at the time of delivery of the goods or services to the nominated delivery address.
6.7.  You indemnify Permanent Cosmetics against any loss or damage suffered by Permanent Cosmetics as a result of delivery, except where caused by Permanent Cosmetics’s negligence.
6.8.Notwithstanding Permanent Cosmetics rights, it may from time to time promote either individual products or categories of products as freight free if an order is in excess of a nominated total transaction $ value.
6.9.  Freight free will only ever mean delivered free of freight cost to the purchaser to any destination that is serviced by Australia Post under it’s’ “Parcels within Australia” service delivery conditions.
6.10.  Permanent Cosmetics reserves the right at any time to withdraw any offer of “Freight Free”, in part or whole at any time without giving notice. If payment has been received prior to such a withdrawal of offer, the funds will be refunded in full.

7.  LIABILITY:

7.1.  Except as specifically set out in these Terms, or contained in any warranty statement provided with the goods or services, any term, condition or warranty in respect of the quality, merchantability, fitness for purpose, condition, description, assembly, manufacture, design or performance of the goods or services, whether implied by statute, common law, trade usage, custom or otherwise, is hereby expressly excluded.
7.2.  Replacement of the goods or re-supply of the services is the absolute limit of Permanent Cosmetics’s liability howsoever arising under or in connection with the sale, use, storage or any other dealings with the goods by you or a third party.
7.3.  Permanent Cosmetics is not liable for any indirect or consequential losses or expenses suffered by you or any third party howsoever caused, including, but not limited to loss of turnover, profits, business or goodwill or any liability to any other party.
7.4.  Permanent Cosmetics will not be liable for any loss or damage suffered by you where Permanent Cosmetics has failed to deliver the goods or services, fails to meet any delivery date or cancels or suspends the supply of goods or services.
7.5.  Nothing in these Terms is to be interpreted as restricting, excluding or modifying the application of any State or Federal legislation applicable to the sale of goods or supply of services which cannot be excluded, restricted, or modified.

8.ACKNOWLEDGEMENTS:

8.1.  You acknowledge that:
8.1.1.  you have not relied on any service involving skill and judgement, or on any advice, recommendation, information, or assistance provided by Permanent Cosmetics in relation to the goods or services or their use or application.
8.1.2.  you have the sole responsibility of satisfying yourself that the goods or services are suitable for your use or contemplated use.
8.1.3.  any description of the goods or services provided by Permanent Cosmetics is given by way of identification only and does not constitute a contract of sale by description.

9.  CANCELLATION:

9.1.  Subject  to clause 3.5:
9.1.1.  if, through circumstances beyond Permanent Cosmetics’s control, Permanent Cosmetics is unable to effect delivery of the goods or services, then Permanent Cosmetics may cancel your order (even if it has already been accepted) by written notice to you.
9.1.2.  Any purported cancellation or suspension by you of an order is not binding on Permanent Cosmetics after that order has been accepted and payment confirmed.

10.  WARRANTY AND RETURNS

10.1.  The goods and services supplied by Permanent Cosmetics are subject to specific warranties that are provided by the manufacturer of the goods.
10.2.  You may return any unopened (sealed) goods supplied by Permanent Cosmetics and obtain a refund of the purchase price less delivery charges and 25% of the cost of the item as restocking fee provided that:
10.3.  the unopened (sealed) goods are returned within 7 days of delivery,
10.4.  the unopened goods are in their original packaging with all accessories included; and
10.5.  you pay all postage charges associated with the return of the goods.
10.6.  Unless a fault is established in the goods, Permanent Cosmetics will not accept the return of any opened (seal broken) goods. You will be responsible for all delivery charges for returning the goods to you.

11.  MISCELLANEOUS:

11.1.  The law of Victoria from time to time governs your contract with Permanent Cosmetics.
11.2.  Failure by Permanent Cosmetics to enforce any of these Terms will not be construed as a waiver of any of Permanent Cosmetics’s rights.
11.3.  If any of these Terms are unenforceable, it must be read down so as to be enforceable, or if this is not possible, it must be severed from the Terms without affecting the enforceability of the remaining Terms.
11.4.  A notice must be in writing and must be sent by mail, facsimile, sms or email to the notified address of the addressee. Notices sent by mail are deemed to be received 2 days after posting. Notices sent by facsimile, sms or email is deemed to be received upon confirmation of successful transmission.
